Introduction

Welcome to Sanjit Bal Hypnotherapy.

 

1.1 This page tells you the Terms and Conditions (‘Conditions’) upon which I will supply Services to you.

 

1.2.’Services' means the services listed on the Website which I may supply.

 

1.3 Before booking a session, I will provide you with a link to these Terms and Conditions. Please read through these carefully, paying particular attention to my cancellation policy at clause 9.

 

1.4 Upon booking a session, you agree to be legally bound by these Conditions. You will be unable to proceed with your transaction if you do not accept these Terms and Conditions.

2.6 I hold a Diploma in Integrative Evidence-based Clinical Hypnotherapy & Mind-Body Health Practice (PDHyp) through the International College of Clinical Hypnotherapy Practitioners.

 

2.7 I am fully insured through Holistic Services Insurance, covering malpractice and professional liability, public liability, and products liability, with comprehensive coverage in place.

 

Services

 

3.1 I provide tailored Hypnotherapy sessions conducted via Zoom or via Jane unless agreed otherwise. Jane is an external platform I use to manage bookings, payments, and client communications. 3.2 It is important to note that Hypnotherapy is a complementary practice and is not a substitute for medical intervention or advice. ​I do not guarantee specific results or outcomes from the sessions, nor do I claim to offer a cure for any condition. If you have any medical or health conditions/ concerns, please consult a healthcare professional before booking a session with me.

Clients are encouraged to continue seeking appropriate medical care as needed.

 

3.3 Hypnotherapy is not suitable for managing certain medical or psychiatric conditions, including but not limited to schizophrenia, depression, Dissociative Identity Disorder (DID), and severe mental health disorders. Clients with such conditions are advised to seek guidance from a qualified medical or mental health professional.

 

Eligibility

 

4.1 To be eligible to purchase Services and lawfully enter into and form a contract with me, you must be 18 years of age or over.

 

4.2 Clients must disclose any medical conditions, mental health conditions, or medications that could affect their suitability for Hypnotherapy. Failure to provide this information may impact the effectiveness or appropriateness of the treatment.

 

Price

 

5.1 The prices of the Services are quoted on the Pricing page of my website

 

5.2 Prices for Services listed on the website are subject to change. I reserve the right to modify pricing at any time, and updated prices will be reflected on the website.

 

5.3 Clients who have already booked and paid for services will be honored at the original price, unless otherwise agreed upon.

 

5.4 Unless otherwise stated, the prices quoted exclude VAT (I am not VAT registered).

 

Booking process and formation of a contract

 

6.1 All bookings and payments are processed through the Jane App

 

6.2 Before booking a session, we will have a quick chat via email or phone to see if I can help with what you're looking for. This is a casual conversation to ensure we are a good fit to work together.

 

6.3 Once you're ready to proceed, we will confirm your preferred date and time for the session. This will follow with a calendar invitation that you will receive via Jane.

 

6.4 You will receive a welcome email which invites you to create an account via the Jane App. In order to proceed, an account is required to be set up. Setting up an account will allow you to: see upcoming/past appointments, complete intake forms, join scheduled video appointments, and view invoices.

 

6.5 Once the appointment is scheduled, I will follow up with an email via Jane to request payment. Please note that all payment must be received before the session can take place.

 

6.6 Once payment is complete, I will send you a receipt via email to acknowledge payment. I will send this via Jane to your email address.

 

6.7 A contract between you and I for the supply of the Services incorporating the version of these Conditions in force at the time of your order, will come into existence at the point of payment, where you will receive a receipt. This will also be recorded in your account area of the Jane App.

 

6.8 I may make:

 

6.8.1. changes to these Conditions as a result of changes in any relevant laws and regulatory requirements,

 

6.8.2 changes to these Conditions as a result of changes in how I accept payment from you,

 

6.8.3 changes in the amount payable by you to the extent of any changes in the VAT includedin the price or payable in relation to the price,

 

6.9 If I make any changes in accordance with clause 6.8 I will give you written notice of the changes before I supply the Services.

 

6.10 Any variation to these Conditions which have been incorporated into the Contract or to the Contract other than those mentioned in clause 6.8 shall only be binding when agreed in writing and signed by you and I.

 

Payment

 

7.1 Payment can be made by any major credit or debit card or by using PayPal or Stripe via Jane Payments in the Jane App.

 

7.2 Jane Payments is secure and PCI compliant. It meets the highest security standard to ensure card data is safe and secure. You can find more information about this here: https://jane.app/features/jane-payments

 

7.3 By booking a service, you consent to payment being charged to your debit/credit card account/Paypal that you provide via the Jane App.

 

7.4 You must pay 100% of the price of the Services in advance. I will make a payment request via the Jane App which you will receive by email. Once you click ‘Pay’, you can submit your debit/card or Paypal details, at which point payment for the session can be made. You also have the option of storing card details in Jane’s secure system for future session payments.

 

7.5 I shall contact you should any problems occur with the authorisation of your card or payment through your PayPal

 

Performance of Services

 

I will make every reasonable effort to provide high-quality hypnotherapy services tailored to your individual needs. All sessions are designed to be effective and professional; however, individual results may vary depending on personal circumstances, commitment, and engagement in the process.

 

8.1 Session Delivery: Services will be provided as agreed upon, either via Zoom or the Jane App, or another mutually agreed-upon platform. The content and approach of each session will be tailored to the goals discussed during our initial consultation and subsequent sessions.

 

8.2 In the event of technical issues affecting the session, we will reschedule at no additional cost to you.

 

8.3 Client Participation: The effectiveness of the services depends on your active participation, openness, and willingness to engage in the process, including following agreed-upon recommendations/homework between sessions. I will provide the necessary tools and support, but your commitment to your goals is essential for success.

 

8.4 Service Modifications: If, at any point during the process, it becomes clear that the approach or methodology needs to be adjusted to better meet your needs, we will discuss and agree upon any modifications to the treatment plan.

 

8.5 It is important to notify me immediately if there are any changes in your health, medications, or mental state during the course of Hypnotherapy.

 

8.6 I will not be responsible for any delay in performing the Services if I have asked you to provide specified information that is necessary for performing the Services and you fail to provide it in the time I request you to supply it by.

 

8.7 As a client, you have legal rights in relation to Services not carried out with reasonable skill and care. Nothing in these Conditions will affect these legal rights.

 

Cancellation policy

 

9.1 When you book a session, you are reserving a dedicated time in my schedule that is no longer available to other clients. I understand that unforeseen events can arise, and I aim to be as accommodating as possible. However, I require at least 24 hours notice in writing if you need to cancel or reschedule your session. This allows me to offer the time slot to another client who may need it.

 

9.2 Cancellations or reschedules made with less than 24 hours’ notice will result in the full session fee being charged unless due to exceptional circumstances, which will be considered at my discretion.

 

9.3 In such cases, rescheduling may be offered as an alternative to cancellation. Refunds for exceptional circumstances are not guaranteed and will be assessed on a case-by-case basis.

 

9.4 Failure to attend the session will result in the full session fee being charged

 

9.5 Should you wish to cancel a session, and provided that more than 24 hours notice is given, you can do so by sending an email stating that you wish to cancel. Please quote your name and a description of the Services so that I can process your request. Full payment will be returned to the original payment method used at the time of booking.

 

9.9 So long as you are entitled to cancel and have complied with your obligations under clause 9.1, I will refund you the payment within 7 working days of my receipt of your cancellation notice. Note that it may take up to 14 days for the payment to be reflected in your account depending on your bank's processing times.

 

Use of Personal data

 

10.1 I am committed to complying with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, as overseen by the Information Commissioner's Office (ICO).

 

10.2 Your personal data will be processed fairly and stored securely in my client management system, Jane, in accordance with the Data Protection Act 2018 and the UK General Data Protection Regulation (GDPR), and in order to deliver the services that you have requested.

 

10.3 When I request information I will alert you to my Privacy Policy.

 

10.4 All information shared during our sessions is strictly confidential, and records - including informal notes and any audio recordings - are securely protected.

 

10.5 Confidentiality will be protected except when:

 

10.5.1 you have provided your consent for it to be disclosed: for example, if you agree to me contacting your GP or another healthcare provider,

 

10.5.2 required by UK law: this includes obligations to report concerns such as terrorism, money laundering, or serious crime,

 

10.5.3 to prevent harm: If there is a risk of harm to yourself or others, I may need to share relevant information with appropriate authorities to ensure safety,

 

10.5.4 Legal proceedings or court orders: If I am legally compelled to disclose information during legal proceedings.For more details on how your personal data is handled, please refer to my Privacy Policy.

 

Complaints procedure

 

11.1 I am committed to providing a professional and high-quality service. If you are unhappy with any aspect of your experience, I encourage you to reach out to me in the first instance so that I can address your concerns promptly and effectively. Please email me at hello@sanjitbal.com.

 

11.2 If you feel that your complaint has not been resolved satisfactorily, you can escalate it to the General Hypnotherapy Standards Council (GHSC). They can be contacted at admin@general-hypnotherapy-register.com.

 

11.3 In the event of a dispute concerning these Conditions, including their interpretation and their application to the circumstances giving rise to the dispute, you or I may refer the dispute to Alternative Dispute Resolution 'ADR'.

 

Limitation of Liability

 

12.1 I will provide services with reasonable care and skill (including tailored Hypnotherapy techniques suited to your needs) and I cannot exclude liability for failing to do so. Your legal rights are unaffected if these duties are not met, and you can seek advice from Citizens Advice if needed.

 

12.2 While hypnotherapy can be highly beneficial and may help in achieving desired outcomes, it is important to understand that results vary from person to person. The effectiveness of Hypnotherapy depends on various factors, including your commitment, engagement, and individual circumstances.

 

12.3 Any testimonials or success stories shared are individual experiences and may not be representative of all clients.

 

12.4 I am not liable for any indirect, incidental, or additional loss or damage that may result from using my Services, except where the law requires otherwise. This includes situations beyond my control or those not directly caused by my actions.

 

Other important terms

 

13.1 I reserve the right to change the domain address of this Website and any services, service prices, service specifications and availability at any time.

 

Governing law

 

14.1 These Conditions and the Contract are governed by the laws of England and Wales. However, if you live outside England and Wales, you are always entitled to any compulsory consumer protections applicable in the country where you live.

 

Governing jurisdiction

 

15.1 You can bring legal proceedings in respect of the Services in the courts of England and Wales.

 

15.2 If you live in Scotland you can bring legal proceedings in respect of the Services in either the courts of Scotland or England and Wales.

 

15.3 If you live in Northern Ireland you can bring legal proceedings in respect of the Services in either the courts of Northern Ireland or England and Wales.

 

15.4 If you reside outside of the U.K, you may bring legal proceedings in the courts of your home country or in England and Wales.

 

Updates

 

16.1 I reserve the right to amend these Terms and Conditions from time to time to reflect changes in my services, legal requirements, or business practices.

 

16.2 Any significant changes will be communicated to clients via email or through an announcement on my website.

 

16.3 By continuing to use my services after such updates, you agree to the revised Terms and Conditions. Please ensure you review these Terms and Conditions regularly to stay informed of any updates.
